ARTICLE III. - OFFENSES AGAINST THE PERSON

  • Sec. 54-96. - Battery.
  • (a)

    It shall be unlawful for any person to commit the crime of battery.

    (b)

    Battery is the intentional use of force or violence upon the person of another; or the intentional administration of a poison or other noxious liquid or substance to another.

  • Sec. 54-97. - Assault.
  • (a)

    It shall be unlawful for any person to commit the crime of assault.

    (b)

    Assault is an attempt to commit a battery, or the intentional placing of another in reasonable apprehension of receiving a battery.

    (c)

    Whoever commits the offense of assault shall be fined not more than $200.00 or confined for not more than 90 days, or both.

  • Sec. 54-98. - Negligent injuring.
  • (a)

    It shall be unlawful for any person to commit the crime of negligent injuring.

    (b)

    Negligent injuring is the inflicting of any injury upon the person of another by criminal negligence.

    (c)

    The violation of any law of the state or any ordinance of the city, punishable by fine and/or imprisonment, shall be considered only as presumptive evidence of such negligence.

  • Sec. 54-99. - False imprisonment.
  • (a)

    It shall be unlawful for any person to commit the crime of false imprisonment.

    (b)

    False imprisonment is the intentional confinement or detention of another, without his consent and without proper legal authority.

    (c)

    Whoever commits the crime of false imprisonment shall be fined not more than $200.00, or imprisoned for not more than six months, or both.

    (Code 1956, § 42-29)
